TERMS & CONDITIONS

The following terms and conditions apply to all transactions with Trade Clientelle.

  • Purchase Orders
    • Xavier Furniture does not acknowledge nor do action verbal orders. All trade client orders must be submitted in writing with complete details.
    • Purchase orders can be submitted by website, email or fax.
  • Payment Options
    • Xavier Furniture does not offer accounts; we operate strictly pro-forma.  Pro-forma invoice will be faxed or emailed once purchase order is received and processed.
    • Xavier Furniture will hold stock for a maximum of 3 business days after the Pro-Forma invoice has been issued to allow for payment. If payment is not received within this time, the stock will be released and allocated to other orders. Availability is subject to change and priority is given to confirmed orders where payment has been received.
    • Xavier Furniture accepts payment by direct deposit, EFTPOS, Visa or Mastercard (Amex subject to 3% surcharge).
    • Cheque Payment is not accepted.
    • Where a deposit has been paid on a piece which is on ‘back order’, full payment is required within 3 business days of being notified that the piece is ready for collection/dispatch. Failure to process payment may result in re-allocation of goods and forfeit of deposit.
    • Full payment is required prior to collection or dispatch.
    • Xavier Furniture does not accept payment direct from trade clients, clients as per Section Pricing Policy
  • Pricing Policy
    • Xavier Furniture will not enter into, or be entered into a purchasing contract or agreement with any persons or parties who have not been qualified first by Xavier Furniture.
    • Trade client pricelists are issued to trade clients for the use and reference of the trade client only. Xavier Furniture will not be held to prices sought verbally or otherwise from staff, agents or representatives. Any quoting provided by Xavier Furniture, verbal or otherwise should always be checked against the trade client’s issued pricelist.
    • Prices are subject to change without notice
  • Product Information
    • Xavier Furniture specialises in hand crafted and finished furniture and accessories. Care instructions must be followed to avoid the risk of voiding the manufactures warranty.
    • Xavier Furniture makes every effort to display product that is a true representation of ordered lines, however variations in colour, finish and sizing are a natural characteristic of any product and do not classify a piece as being faulty or damaged.
    • Sizes listed are measured from the extremities and are quoted as width x height. Handcrafted sizing can vary and has an acceptable tolerance of up to 20mm.
    • Upholstered items sold as ‘White Price’ include upholstery by Xavier Furniture. Fabric is to be selected and supplied by the trade client. Fabric meterage is provided by Xavier Furniture to cover quantities for plain fabric. Patterned fabric and leather ‘hide’ quantities are to be calculated by the trade client. Xavier Furniture does not accept any responsibility for shortage or excess of fabric.
  • Freight
    • Freight is the responsibility of the Trade Client.
    • Xavier Furniture encourages the Trade Client to be present for all deliveries, and discourages the direct contact between carrier's and your clients.
    • Xavier Furniture may offer to book freight only on behalf of the trade client, leaving coordination and finalisation of the freight booking to be managed by the trade client.
    • Trade Clients are not obliged to accept our freight booking offer.
    • The Trade Client remains responsible for any freight insurance and freight related issues (cover, loss and damage insurance recommended).
    • Xavier Furniture may offer to book freight only on behalf of the trade client, leaving coordination and finalisation of the freight booking to be managed by the trade client.
    • In the majority of cases, freight bookings by Xavier Furniture are subsidized by Xavier Furniture. 
    • Xavier Furniture freight charges do not include installation (delivery only).  Installation can be arranged and quoted prior to dispatch of your order.  POA
    • In the event of any damage, please retain any packaging.
    • Freight damage must be pointed out to the carrier upon arrival and noted by receiver on delivery documents.
  • Collection of Goods
    • Full payment is required prior to collection or dispatch being arranged.
    • A minimum of 48 hours notice is required when collecting goods from our warehouse. 
    • If collecting bulky items from the showroom in person, instead of arranging a carrier, please bring appropriate transport protection and enough people to assist loading the piece.
    • Occupational health and safety prohibit our staff from assisting with loading into your vehicle.
    • Upon client notification, received goods will be held or ‘stored’ for a maximum of 14 days without charge. After 14 days a warehouse storage fee will be applicable at $10 per cubic meter, per day.
    • You / your nominated carrier will sign a Packing Slip at time of collection to verify that goods have been collected in good order and condition.
  • Cancellations/Change of mind
    • Order cancellations received 24 hours after payment of deposit/invoice will incur a 20% processing fee.
    • Change of mind on purchased items is an option prior to dispatch only. 48 hours notice is required to avoid our standard 20% restocking fee.
    • Once deposit/invoice has been paid, custom orders cannot be cancelled without forfeiting full payment.
  • Returns
    • All returns are to be authorised at the discretion of Xavier Furniture or the respective principal. 
    • If authorized, returns are limited to a Credit Note only (refunds not available).
    • In some instances a 20% re-stocking fee may be deducted from the Credit amount.
    • Xavier Furniture liability is limited to the product not the freight or re-delivery or other consequential occurrences.  
  • Claims
    • Xavier Furniture must be advised of any faults or damages no later than 7 days after receipt of goods. 
    • Xavier Furniture is not responsible for goods damaged in transit by the Customer’s nominated carrier or any carrier selected by Xavier Furniture on behalf of the client. 
    • It is the client’s responsibility to inspect goods upon receipt.  Transit damage must be pointed out to the carrier on arrival and noted on delivery documents.
    • It is the Trade client’s responsibility to submit complaints of faults in writing and supply photographic evidence to the claims department.
    • Xavier Furniture liability is limited to the product replacement not the freight or re-delivery or other consequential occurrences.  
    • In line with Queensland Office of Fair Trading, it is at the discretion of Xavier Furniture how the claim will be resolved ie. replace goods / repair goods / provide refund.
    • Claims will not be accepted where product has been modified after purchase (eg. Upholstery / Colour Change, etc).
    • Xavier Furniture is not responsible for goods damaged in transit by the customer's nominated carrier or any carrier selected by Xavier Furniture on behalf of the trade client.
    • In the event of damages, please retain any packaging.
    • Freight damage must be pointed out to the carrier upon arrival and noted by receiver on delivery documents.
  • Online Retailing:  Xavier Furniture does not permit online retailing of any products, nor the use of our images, without written permission directly from Head Office.
  • Loans
    • All loans will be authorised at the discretion of Xavier Furniture.  Some items are not made available for loan. 
    • Authorised loans require a credit card number to be taken to cover the cost of the item or repair/cleaning of the item if required.
    • Xavier Furniture standard Loan Agreement covering terms and conditions of the loan must be read and agreed to by signing.
    • It is the trade client’s responsibility to return loaned items to the showroom within the time agreed and in the same condition as when collected. Failure to so will result in the processing of full payment using the trade client’s credit card details as per the standard Loan Agreement terms.
  • Showroom
    • We encourage Trade Clients to visit our showroom to inspect pieces.
    • Trade Clients with appointments are treated with priority.  Members of the Public are requested to phone ahead to make an appointment.
    • It is preferred that you accompany your clients to the showroom.  If you cannot attend, please register your client with Xavier Furniture administration and call to make an appointment for them on your behalf. 
    • Xavier Furniture operates a trade showroom in a warehouse environment. Children are not encouraged to visit our showrooms. 
    • Any damages must be paid for in full.
