These Terms & Conditions apply to purchases made through the Xavier Furniture Clearance Collection website.
The Clearance Collection operates as an online purchasing platform. Products are purchased and paid for through the website at the time of ordering.
Products and Prices
All Clearance Collection products are offered at the price displayed on the website at the time of purchase.
Clearance pricing applies only to purchases completed through the Clearance Collection website and cannot be combined with Xavier Furniture Trade or Wholesale pricing, discounts or other offers unless otherwise stated.
Products are subject to availability and quantities may be limited.
Every effort is made to ensure product descriptions, dimensions, finishes, photographs and pricing are accurate. Colours and finishes may vary slightly due to photography, lighting, screen settings and the natural characteristics of materials.
Many Xavier Furniture pieces are handcrafted. Natural variations in colour, grain, texture, finish and construction are part of the individual character of these products and are not necessarily considered faults.
Orders and Payment
Payment is required in full at the time of ordering through the Clearance Collection website.
An order is confirmed once payment has been successfully processed and an order confirmation has been issued.
If, due to an inventory or website error, a purchased product is subsequently found to be unavailable, Xavier Furniture will contact the purchaser and provide a full refund for the unavailable item.
Clearance Collection purchases are processed separately from Xavier Furniture Trade and Wholesale orders and cannot be combined with Trade or Wholesale invoices, discounts or payment arrangements.
Delivery
Delivery charges are available through the Clearance Collection website are:

For other locations, or orders exceeding the applicable volume allowance, a freight quotation will be required.
Delivery charges are based on the delivery information supplied at checkout.
Additional charges may apply for unusual or difficult access, stairs, restricted access, redelivery, storage or other circumstances not disclosed when the order is placed.
Customers are responsible for checking that products will fit through doorways, lifts, stairways and other access points at the delivery address.
Delivery dates and times provided are estimates and may be affected by circumstances outside Xavier Furniture’s reasonable control.
Collection
Collection from Xavier Furniture at Loganholme is available free of charge by prior appointment.
Customers selecting collection should wait until Xavier Furniture has advised that their order is ready before arranging collection.
Once goods have been collected, the purchaser is responsible for arranging suitable transport and ensuring the goods are appropriately protected during transportation.
Inspection of Goods
Customers should inspect their goods as soon as reasonably possible following delivery or collection.
If an item arrives damaged, appears faulty or is not the product ordered, please contact Xavier Furniture promptly with the order details and photographs so the matter can be assessed.
Please retain the original packaging where reasonably possible until the matter has been resolved.
Where there is an apparent fault or damage, the product should not be modified, installed, permanently fixed, siliconed, screwed together or otherwise altered before Xavier Furniture has had a reasonable opportunity to assess the issue.
Change of Mind
Please select Clearance Collection products carefully.
Xavier Furniture does not offer refunds or exchanges simply because a customer changes their mind, makes an incorrect selection or the product does not fit the intended space.
This does not affect any rights or remedies available under the Australian Consumer Law.
Faulty or Damaged Goods
Clearance pricing does not remove a customer’s rights under the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Where goods fail to meet an applicable consumer guarantee, the customer may be entitled to a repair, replacement, refund or other remedy depending upon the circumstances and whether the failure is major or minor.
Where a particular fault, imperfection, damage or condition has been clearly disclosed to the customer before purchase, that disclosed condition will not generally provide grounds for a remedy in relation to that particular issue.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer right or remedy that cannot lawfully be excluded.
Freight Damage
If goods are delivered by a carrier arranged through Xavier Furniture and appear to have been damaged in transit, please notify Xavier Furniture promptly and provide photographs of the product and packaging where possible.
If a purchaser arranges their own carrier or transport, responsibility for transit arrangements and any applicable freight insurance rests with the purchaser, subject always to any rights that cannot be excluded under Australian law.
Product Modification and Installation
Products should be inspected before installation or permanent placement.
A product must not be modified, siliconed, screwed together, permanently fixed or otherwise altered where a fault or concern has been identified without prior written approval from Xavier Furniture.
Unauthorised modification may affect the ability to determine the cause of a problem and may affect any warranty claim to the extent permitted by law.
Nothing in this provision excludes any rights available under the Australian Consumer Law.
Clearance Collection and Trade/Wholesale Clients
The Clearance Collection is a separate online purchasing platform available at the prices and terms displayed on the Clearance Collection website.
Xavier Furniture Trade and Wholesale clients wishing to purchase under their normal Trade or Wholesale arrangements should order through the main Xavier Furniture website or their usual Xavier Furniture ordering process.
Clearance Collection purchases cannot be transferred to, combined with or retrospectively converted into Trade or Wholesale orders.
Privacy
Personal information collected through the Clearance Collection website will be handled in accordance with the Xavier Furniture Privacy Policy.
Information required to process and fulfil an order may be provided to relevant service providers, including payment processors, freight and delivery providers and website service providers.
General
Xavier Furniture may update these Terms & Conditions from time to time. The Terms & Conditions applying to an order are those published on the website at the time the order is placed.
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
These Terms & Conditions are governed by the laws of Queensland, Australia.
